What Is Succession?

In Louisiana, our laws are unique in that they are based upon civil law that has roots in both French and Spanish codes. Because of this difference, the terminology used to describe some legal concepts may also be different. However, the actual succession process isn’t that different from the probate process.

In Louisiana, succession refers to the process of transferring assets from a deceased person to his or her heirs or beneficiaries. Throughout this process, the term estate is used to refer to the property that a person owned at the time of death. According to Louisiana law, all property, rights, and obligations that a person leaves after his or her death, and rights ad obligations that don’t arise until after death are all included as the deceased’s estate.
